Who we are

Agencia FX is the trade name of Asesoría Informática Fabio Xavier do Nascimento E.I.R.L., a company registered in Chile (RUT 77.288.907-0), at Parque Nacional Pan de Azúcar 654, Coquimbo 1801554, Chile. We are the controller of the information described here. You can reach us at fabio.nascimento@agenciafx.com.

What we collect

Business contact details published by a company on its own website or in public business directories such as OpenStreetMap: company name, website, business email address, city, and what the company says publicly about its services.
What you send us through our website form or by replying to our emails: your name, work email, company and message.
Basic email data: whether a message we sent was opened (through a small tracking image) and whether you replied. We use this only to know if our emails are being delivered and read.

We do not look for personal information beyond business contact details, and we do not buy contact lists.

How we use it

To send a short series of one-to-one business emails about how our services could help your company. A contact receives at most four messages, and the sequence stops as soon as you reply or ask us to stop.
To answer your questions and prepare the written assessments and proposals you ask for.
To keep a record of our business correspondence in our own CRM.

Why we are allowed to contact you

In the United Kingdom and the EEA, we rely on our legitimate interest in offering our services to other businesses (UK GDPR Article 6(1)(f)). We write only to addresses a company publishes for business contact, only to companies (not to sole traders or individuals), and only about matters relevant to the recipient's role. In Canada we rely on implied consent under CASL, in Australia on inferred consent under the Spam Act, and in New Zealand on deemed consent under the UEMA, on the same basis: the address is conspicuously published and the message is relevant to the business. If a website states that it does not want unsolicited messages, we do not write to it. In the United States our messages follow CAN-SPAM, including a valid postal address and a working opt-out.

Who else processes it

We use service providers that process this information on our behalf: Google Workspace (email), OpenAI (AI tools that help us read public website text and draft messages), FormSubmit (delivery of our website form), Hostinger (website hosting) and our own servers for the CRM. Your information may be processed in Chile, the United States and the European Union. We never sell it or share it for anyone else's marketing.

How long we keep it

We keep our correspondence and CRM records while they are useful to our business relationship. If you ask us to stop contacting you, we keep your email address on a do-not-contact list, precisely so we don't write again. You can ask us to delete your information at any time.

Your rights

You can ask us to give you a copy of the information we hold about you, correct it, delete it, or object to how we use it. Write to fabio.nascimento@agenciafx.com and we will reply within 30 days. If you are not satisfied, you can complain to your data protection authority: the ICO in the United Kingdom, the Office of the Privacy Commissioner in Canada, the OAIC in Australia, the Office of the Privacy Commissioner in New Zealand, or the Consejo para la Transparencia in Chile.

Changes

If we change how we handle this information, we will update this page and the date at the top.
